For those who meet the standard, it is one of the most powerful immigration options available — but understanding whether you qualify, how USCIS evaluates petitions, and what the current landscape looks like is essential before moving forward.

Most employment-based Green Card pathways require an employer to initiate and sponsor the process. The EB-1A is a meaningful exception. Because it allows self-petitioning, the applicant — not an employer — drives the process. The petition is built around the applicant’s own record of achievement and filed using Form I-140, Immigrant Petition for Alien Workers, with U.S. Citizenship and Immigration Services (USCIS).
